Brian Ledebuhr represents owners, board members, in-house attorneys and other C-suite executives navigate and resolve complicated litigation and arbitration matters, including disputes regarding fiduciary duties, restrictive covenants, trade secrets, contracts, insurance coverage and recalls/product liability.

Brian’s experience extends to every phase of litigation, from emergency injunctions through trial and appeal in a variety of complex commercial litigation cases. He has favorably resolved director and officer investigations, franchise and distributor disputes, shareholder derivative actions, ownership disputes, and other business tort matters in both federal and state courts across the country.

Brian also regularly represents clients in First Amendment matters, advises on e-discovery issues and handles securities litigation. Additionally, he has considerable experience counseling professional associations and defending companies against class action claims, including those under the Telephone Consumer Protection Act (TCPA), the Fair Debt Collection Practices Act (FDCPA), the Illinois Biometric Information Privacy Act (BIPA) and the Illinois Genetic Information Privacy Act (GIPA).

In all of his work, Brian takes a thoughtful, pragmatic approach and applies his experience to find critical leverage points that lead to efficient, cost-effective solutions for his clients.

I enjoy thinking outside of the traditional litigation box, finding creative solutions to put my clients in the best possible position at the lowest cost.

Experience

  • Represented a client in connection with a complicated tax dispute regarding corporate reorganization prior to closing a deal to purchase a company. The dispute involved conflicting interpretations of the purchase agreement and corresponding indemnification obligations for post-closing tax liability.
  • Secured a multimillion-dollar settlement for a client with its insurance carrier in connection with a coverage dispute following a multinational product recall.
  • Represented a manufacturer in seeking emergency injunctive relief against a supplier in a contract dispute. Timing was important in ensuring the client could continue to receive supplies from the supplier during the client's busiest season. We negotiated a multimillion-dollar resolution that provided the client with several layers of protection and allowed for a continued relationship with the supplier.
  • Successfully defended clients against fraud claims in connection with representations and warranties made at the closing.
