Taking a practical, business-smart approach, Libby guides her clients through sensitive and high-stakes employment matters and represents them in single-plaintiff and class action litigation, in arbitration and before state and federal agencies.

Libby is known for her responsiveness and business-savvy counsel designed to minimize liability while meeting her clients’ needs. She advises on day-to-day workplace decisions, hiring, employee discipline, leaves of absence, terminations, harassment, discrimination and retaliation allegations, among other workplace issues. She guides employers through investigations, internal complaints and whistleblower claims based on their risk profile, operational priorities and business objectives.

Clients also rely on Libby to structure and negotiate employment and separation agreements, audit workplace policies and training practices, and conduct employment-related due diligence in corporate transactions. They also frequently retain her to serve as an independent investigator in workplace investigations involving senior personnel.

Experience

  • Advised an educational institution and its board of directors on the complex exit of a top executive accused of unprofessional behavior and negotiated a fulsome separation agreement, which allowed the client to appropriately manage and address its reputational and liability risks.
  • Investigated significant allegations of racial harassment made against transportation company, which required engagement with law enforcement and civil rights agencies, and advised the client regarding investigation results and next steps.
  • Represented a manufacturing and distribution client in mediating claims brought by a former executive alleging gender discrimination and securities law violations, resulting in the execution of a favorable settlement agreement by the former executive.
  • Represented a healthcare entity in a class action filed in Chicago by former employees alleging sexual harassment, negligence and invasion of privacy, and resolved such action with class members on terms satisfactory to the client.
  • Investigated serious allegations of sexual, sexual orientation and disability harassment and discrimination and retaliation made against a Chicago-based law firm and advised client on factual findings and legal risk associated with same.
  • Advised an industry-leading investment bank regarding allegations of sex-based discrimination, harassment and retaliation and negotiated resolution of those claims to the client's satisfaction.
