Bryan Clark represents clients in complex litigation, with a focus on media, privacy and First Amendment defense.
He has particularly deep experience with class action litigation and has handled a variety of general commercial litigation matters and business disputes. He also guides clients through the complexities of data privacy compliance.
Media outlets and digital content creators rely on Bryan to defend against defamation, right of publicity, newsgathering and privacy claims. His background as a journalist gives him a valuable perspective when advising on press rights and editorial risk. In litigation, he is strategic and assertive, pursuing early motions to dismiss and applying pressure at every stage to avoid costly discovery when possible.
In the data privacy space, Bryan counsels clients on compliance with applicable laws and regulations including the GDPR, GLBA (including Reg S-P), state data privacy laws (like the CCPA) and data breach notification statutes. He helps develop internal privacy protocols, advises on policy language and assists in responding to data security incidents, including ransomware attacks involving multinational threat actors. Clients count on him for clear, business-oriented advice that aligns legal obligations with operational goals.
Beyond his media and privacy work, Bryan often defends clients in class actions, drawing on over 15 years of focused experience. Bryan also is committed to pro bono service, particularly work with student journalists, First Amendment scholars, guardians ad litem and nonprofit founders.
Experience
- Represented a large national news network in high-profile defamation litigation. The matter was extremely challenging and complicated, but the stakes were high and the Vedder Price team positioned the client for a successful resolution.
- Represented a national telephone directory in multiple pieces of litigation challenging its ability to publish information about individuals, raising novel First Amendment arguments to challenge laws in multiple states.
- Represented an international litigation support vendor in complex privacy litigation arising from a data security incident. The client was facing millions of dollars in potential liability, and the Vedder Price team was able to position the case for a mutually agreeable settlement.
- Defeated class certification in an employment class action by identifying individualized issues that precluded class treatment.
- Helped a client respond to the theft of millions of dollars from a Bitcoin wallet by a North Korean state actor, recovering a significant portion of the stolen funds and leading to a criminal indictment.
